PHẦN MỞ ĐẦU
Kế thừa hai ngh́n năm truyền thống ḥa b́nh, an lạc, giải thoát của Đạo
Phật, người Phật tử Việt Nam tại Uùc Đại Lợi – Tân Tây Lan nguyện thực
hiện lư tưởng phục vụ dân tộc và nhân loại.
Giáo Hội Phật Giáo Việt Nam Thống Nhất Hải Ngoại tại Úc Đại Lợi – Tân
Tây Lan không đặt sự tồn tại của ḿnh trong vị thế cá biệt, mà đặt ḿnh
trong sự tồn tại của dân tộc và nhân loại.
Các tông phái, hệ phái Phật giáo Việt Nam đang sinh hoạt tại Uùc Đại Lợi
– Tân Tây Lan kết hợp thành một cơ chế để xiển dương đạo pháp, theo
truyền thống của Giáo Hội Phật Giáo Việt Nam Thống Nhất ( GHPGVNTN) tại
quê nhà.
Tiếp tục thực hiện hoài băo thống nhất theo tinh thần từ bi, lợi tha,
nếp sống lục ḥa của hai giới Tăng sĩ, Cư sĩ để tự tồn và phát triển đó
là sắc thái đặc biệt của nền thống nhất Phật Giáo Việt Nam tại Úc Đại
Lợi – Tân Tây Lan.
CHƯƠNG MỘT
DANH HIỆU – HUY HIỆU – GIÁO KỲ – GIÁO CA – KHUÔN DẤU
Điều 1: Các tông phái, hệ phái, Đoàn Thể Phật Giáo Việt Nam tại
Úc Đại Lợi và Tân Tây Lan kết hợp thành một tổ chức lấy danh hiệu là
Giáo Hội Phật Giáo Việt Nam Thống Nhất Hải Ngoại tại Úc Đại Lợi – Tân
Tây Lan. (Trong Hiến Chế này gọi tắt là Giáo hội, viết tắt là GHPGVNTN/HN
tại UĐL-TTL. Tên Anh ngữ là The Unified Vietnamese Buddhist Congregation
of Australia – New Zealand)
Điều 2: Huy hiệu của Giáo Hội là h́nh Pháp luân (có 12 căm theo
h́nh)
Điều 3: Giáo kỳ của Giáo Hội là cờ Phật Giáo quốc tế.
Điều 4: Giáo ca là bài Phật Giáo Việt Nam của nhạc sĩ Lê Cao Phan.
Điều 5: Khuôn dấu của Giáo Hội được quy định trong Nội quy.
CHƯƠNG HAI
MỤC ĐÍCH – TRỤ SỞ – THÀNH VIÊN
Điều 6: Điều hợp các tông phái, hệ phái Phật Giáo Việt Nam tại Úc
Đại Lợi – Tân Tây Lan để hoằng dương chánh pháp, phục vụ dân tộc và nhân
loại.
Điều 7: Trụ sở Giáo Hội đặt tại nơi vị Hội Chủ đương nhiệm.
Điều 8: Thành viên của Giáo Hội là:
-
Các Tỳ Kheo, Tỳ Kheo Ni, là thường trú nhân hay công dân
Úc Đại Lợi- Tân Tây Lan.
-
Các Tự Viện, Phật Học Viện, Tu Viện, Tịnh Xá, Niệm Phật Đường v.v…
-
Các đoàn thể Cư sĩ Phật tử
chấp nhận và thực hiện Hiến Chế này
Điều 9: Giáo Hội chỉ yểm trợ tinh thần các thành viên trong mọi
sinh hoạt hợp đạo pháp và luật pháp. Giáo Hội không chịu trách nhiệm về
mọi hành vi phạm pháp.
CHƯƠNG BA
HỆ THỐNG TỔ CHỨC – ĐIỀU HÀNH – NHIỆM KỲ
Điều 10: Giáo Hội gồm có bốn cơ cấu: Hội Đồng Chứng Minh, Hội
Đồng Giáo Phẩm Trung Ương, Hội Đồng Tăng Ni, Hội Đồng Điều Hành.
Điều 11: Hội Đồng Chứng Minh là chư tôn Ḥa Thượng thuộc Phật
Giáo Việt Nam do Đại Hội Khoáng Đại cung thỉnh.
Điều 12: a) Hội Đồng Giáo Phẩm Trung Ương gồm có 9 vị, là chư tôn
từ 25 tăng lạp trở lên, do Hội Đồng Tăng Ni suy cử và được Đại Hội
Khoáng Đại cung thỉnh.
b) Các thành viên Hội Đồng này tuyển thỉnh vị Chánh Thư Kư để điều phối
các sinh hoạt của Hội Đồng.
c) Các thành viên khác trong Hội Đồng có thể kiêm nhiệm các
chức vụ của Hội Đồng Điều Hành.
Điều 13: Hội Đồng Tăng Ni là những Tỳ Kheo, Tỳ Kheo Ni thành viên
Giáo Hội, từ năm (5) tăng lạp trở lên, đang hành đạo tại Úc Đại Lợi -
Tân Tây Lan.
Điều 14: Hội Đồng Điều Hành gồm có:

Điều 15:
a) Hội
Chủ và 4 Phó Hội Chủ do Hội Đồng Giáo Phẩm Trung Ương tuyển thỉnh trong
số các thành viên thuộc hội đồng.
b) Các
chức vụ c̣n lại do Đại Hội Khoáng Đại bầu cử, nếu cần do Hội Đồng Giáo
Phẩm Trung Ương mời và Đại Hội Khoáng Đại biểu quyết.
c) Tổng
Thư Kư, Chánh Thủ Quỹ và các Tổng Vụ Trưởng do Tăng Ni đảm nhiệm
d) Các
chức vụ khác do Tăng Ni hay Cư sĩ đảm nhiệm.
Điều 16: Văn Pḥng Thường Trực của Hội Đồng Điều Hành gồm:

Điều 17: Nhiệm kỳ của:
a) Hội
Đồng Chứng Minh là vô hạn định, số thành viên do Đại Hội Khoáng Đại
quyết định.
b) Hội
Đồng Giáo Phẩm Trung Ương là bốn (4) năm, số thành viên do Hội Đồng Tăng
Ni quyết định.
c) Hội
Đồng Điều Hành là bốn (4) năm. Các thành viên trong Hội Đồng có thể được
tái cử.
CHƯƠNG BỐN
NHIỆM VỤ - QUYỀN HẠN
Điều 18: Hội Đồng Chứng Minh: Chứng minh về mặt tinh thần và tiêu
biểu đạo hạnh trang nghiêm Giáo Hội.
Điều 19: Hội Đồng Giáo Phẩm Trung Ương:
-
Giám sát, bảo vệ tinh thần thực thi Hiến Chế
-
Duyệt xét, tấn phong, chế tài hàng giáo phẩm Tăng Ni trong Giáo Hội
-
Chuẩn y kết quả các Đại hội của Giáo Hội
-
Chứng minh các kỳ Đại hội, Đại lễ, Đại Giới Đàn
-
Ban hành những quyết nghị ấn định đường hướng sinh hoạt của Giáo Hội.
Điều 20: Hội Đồng Tăng Ni có nhiệm vụ duy nhất là suy cử các
thành viên Hội Đồng Giáo Phẩm Trung Ương tại mỗi kỳ Đại Hội Khoáng Đại
của Giáo Hội.
Điều 21: Hội Đồng Điều Hành:
-
Đôn đốc, khuyến khích, nâng đỡ Tăng Ni, Phật tử hành đạo, tu tập.
-
Thi hành và tu chính Nội Quy Giáo Hội theo tinh thần Hiến Chế.
-
Thực thi các quyết nghị của các Đại Hội Giáo Hội.
-
Ban Thông điệp vào các dịp đại lễ Phật Đản, Vu Lan, Tết Nguyên Đán v.v…
-
Hội Chủ, Tổng Thư Kư và Chánh Thủ Quỹ thay mặt Hội Đồng Điều Hành duy
tŕ tư cách pháp nhân của Giáo Hội.
CHƯƠNG NĂM
CHẾ TÀI – GIẢI NHIỆM
Điều 22: Các thành viên trong Hội Đồng Giáo Phẩm Trung Ương, Hội
Đồng Điều Hành có thể bị chế tài:
a) Nếu
là thành viên Hội Đồng Giáo Phẩm Trung Ương hay Hội Chủ, Phó Hội Chủ,
th́ sự chế tài chỉ thực hiện khi ít nhứt có ba (3) thành viên Hội Đồng
gởi thư đề nghị lên Giáo Phẩm Trung Ương. Chánh Thư Kư của Hội Đồng Giáo
Phẩm Trung Ương phải triệu tập một phiên họp Hội Đồng trong ṿng một
tháng để giải quyết.
b) Nếu
là thành viên Hội Đồng Điều Hành th́ sự chế tài chỉ thực hiện khi có ít
nhất năm (5) thành viên Hội Đồng gởi thư đề nghị lên Hội Đồng Điều Hành.
Tổng Thư Kư Hội Đồng Điều Hành trong ṿng một tháng phải triệu tập
phiên họp Hội Đồng để giải quyết.
c) Các
biểu quyết chế tài hay giải nhiệm do toàn thể thành viên của Hội Đồng
liên hệ quyết định.
Điều 23: Trường hợp thành viên Hội Đồng Giáo Phẩm Trung Ương, Hội
Đồng Điều Hành khuyết tịch hoặc bị giải nhiệm th́ Hội Đồng liên hệ điền
khuyết vị khác.

TÀI SẢN
Điều 24: Tài sản của Giáo Hội:

Động sản và bất động sản hiến cúng cho Giáo Hội.

Động sản và bất động sản do Giáo Hội tự tạo
Điều 25:
Các thành viên Giáo Hội có tư cách pháp lư riêng độc lập và về mặt hành
chánh và tài chánh.
CHƯƠNG BẢY
ĐẠI HỘI BẤT THƯỜNG - ĐẠI HỘI KHOÁNG ĐẠI
Điều 26: Hội Chủ và Tổng Thư Kư Hội Đồng Điều Hành phải triệu tập
Đại Hội bất thường trong ṿng hai (2) tháng, nếu nhận được thư yêu cầu
của ít nhất phân nửa thành viên Hội Đồng Điều Hành hay phân nửa cơ sở tự
viện trực thuộc.
Điều 27: Đại Hội Khoáng Đại do Hội Chủ triệu tập bốn (4) năm một
lần:
-
Kiểm điểm Phật sự trong nhiệm kỳ qua
-
Đặt kế hoạch và chương tŕnh hoạt động cho nhiệm kỳ tới
-
Cung thỉnh thêm thành viên Hội Đồng Chứng Minh, nếu cần.
-
Cung thỉnh Hội Đồng Giáo Phẩm Trung Ương và cung cử Hội Đồng Điều Hành
nhiệm kỳ mới.
Điều 28: Thành phần tham dự Đại Hội gồm có:
-
Hội Đồng Giáo Phẩm Trung Ương
-
Hội Đồng Điều Hành
-
Toàn thể thành viên Tăng Ni trong Giáo Hội.
-
Đại biểu các Tu viện, Tự viện, Phật học viện, Tịnh xá, Niệm Phật đường
v.v…
-
Đại biểu các đoàn thể Cư sĩ, Phật tử.
CHƯƠNG TÁM
TU CHÍNH – BAN HÀNH – ÁP DỤNG HIẾN CHẾ
Điều 29: Thành viên Giáo Hội có thể đề nghị tu chính Hiến Chế
nhân các kỳ
Đại Hội.
Điều 30: Các đề nghị tu chính Hiến Chế phải gởi đến Ban Tổ Chức
một tháng trước kỳ Đại Hội và phải được hai phần ba tổng số Đại Biểu Đại
Hội
thông qua.
Điều 31:
Hội Đồng Giáo
Phẩm Trung Ương duyệt y và ban hành Hiến Chế được tu chính trong ṿng
một tháng sau Đại Hội.
Điều 32: Bản Hiến Chế Giáo Hội Phật Giáo Việt Nam Thống Nhất Hải
Ngoại tại Úc Đại Lợi – Tân Tây Lan có tám (8) chương, ba mươi hai (32)
điều, được tu chính tại Đại Hội Khoáng Đại kỳ II của Giáo Hội từ ngày 29
đến 31 tháng 8 năm 2003 được ban hành và có hiệu lực áp dụng từ ngày 1
tháng 9 năm 2003.

The Unified
Vietnamese Buddhist Congregation in Australia and New Zealand
(Incorprating Amendments passed at the National Congress of 31st August
2003)
CONSTITUTION
PREAMBLE
Inheriting a Buddhist tradition of 2000 years of peace, tranquility and
liberation, Vietnamese Buddhists are committed to the ideal of serving
Vietnamese people and humankind.
The Unified Vietnamese Buddhist Congregation in Australia and New
Zealand does not hold itself apart from but as part of Vietnamese people
and humankind.
The different schools and lineages of Vietnamese Buddhism active in
Australia and New Zealand vow to unite and serve all living beings and
the Teachings of the Buddha in accordance with the existing traditions
of the Unified Vietnamese Buddhist Church in Vietnam.
The distinguishing character of the unity of Vietnamese Buddhism in
Australia and New Zealand is the continual aspiration for unity in a
spirit of true compassion, alturism and harmony for both the Sangha and
the Laity in order to develop and maintain leadership within the
assembly.
SECTION 1
TITLE
- EMBLEM - FLAG - ANTHEM - OFFICIAL STAMPS
Article 1:
The Schools, Lineages and Organisations of Vietnamese Buddhism in
Australia and New Zealand unite under the title of the
Unified Vietnamese Buddhist Congregation in Australia and New Zealand
(abbreviated as “UVBC”), hereinafter titled the “Congregation”. The
Vietnamese title is Giao Hoi Phat Giao Viet Nam Thong Nhat Hai Ngoai
tai Uc Dai Loi - Tan Tay Lan, (abbreviated as GHPGVNTNHN UDL-TTL).
Article 2:
The Emblem of the Congregation shall be the Dharma Wheel (Dharmachakra)
(with 12 spokes as illustrated)
Article 3:
The Flag of the Congregation shall be the International Buddhist Flag.
Article 4:
The Anthem of the Congregation shall be Phat Giao Viet Nam by
Maestro Le Cao Phan.
Article 5:
The Official Stamps of the Congregation shall be used in accordance with
the Rules of the Congregation.
SECTION 2
PURPOSE - OFFICE - MEMBERSHIP
Article 6:
The Purpose of the Congregation shall be to co-ordinate the Schools and
Lineages of Vietnamese Buddhism in Australia and New Zealand in
propagating True Buddha Dharma and in serving the people.
Article 7:
The Office of the Congregation shall be located wherever the current
Head of the Congregation presides.
Article 8:
Membership of the Congregation shall comprise:–
·
Monks and Nuns (i.e. Bhikkhus and Bhikkunis) who are
Australian or New Zealand citizens or permanent residents,
·
Constituent bodies of Buddhist Temples, Institutes, Monasteries,
Retreat Houses, Prayer Halls, etc…, and
·
Lay Buddhist Organisations,
who accept this Constitution and put it into
effect.
Article 9:
The Congregation will only provide spiritual support to members in their
activities which conform with the Dharma and the law of the land.
The Congregation bears no responsibility for any illegal action.
SECTION 3
ORGANISATION - MANAGEMENT - TERM OF OFFICE
Article 10:
The Congregation shall comprise four (4) elements: the Board of Patrons,
the Central Sangha Council, the Council of Clergy, and the Executive
Council.
Article 11:
The Board of Patrons shall comprise Most Venerable Members of the Sangha
(Maha-Thera) invited by a General Congress of the Congregation to
act as Patrons of the Congregation.
Article 12:
(a) The Central Sangha Council comprises nine (9) members of the Sangha
with at least twenty-five (25) years seniority, who are nominated by the
Council of Clergy and invited to serve by a General Congress.
(b) Members of this Council elect a Chief
Secretary to co-ordinate the activities of the Council.
(c) All other members of this Council may also
hold other offices on the Executive Council.
Article 13:
The Council of Clergy comprises Monks and Nuns (Bhikkhus and
Bhikkunis) who are members of the Congregation, have five (5) or
more years seniority and practise the Way in Australia and New Zealand.
Article 14:
The Executive Council shall comprise:

The Head of the Congregation

Deputy Head of the Congregation for Internal Affairs
·
Deputy Head of the Congregation for External Affairs
·
Deputy Head of the Congregation for New Zealand
·
Deputy Head of the Congregation for Planning
·
General Secretary
·
Two (2) Deputy General Secretaries
·
Treasurer
·
Deputy Treasurer
·
Commissioner for Clergy Affairs
·
Deputy Commissioner for Clergy Affairs
·
Assistant Commissioner for Bhikkuni Affairs Section (Part of the
Clergy Affairs Commission)
·
Commissioner for Dharma Propagation
·
Deputy Commissioner for Dharma Propagation
·
Commissioner for Culture and Education
·
Deputy Commissioner for Culture and Education
·
Commissioner for Buddhist Youth Groups and Youth Affairs
·

Article 15:
(a) The Head and the four (4) Deputy Heads of the Congregation shall be
selected by the Central Sangha Council from among its members.
(b) All other office bearers shall be elected
by a General Congress of the Congregation or, if necessary, appointed by
the Central Sangha Council to fill the office, such appointment to be
approved by a General Congress of the Congregation.
(c) The positions of General Secretary,
Treasurer and Commissioner shall be filled by members of the Sangha.
(d) Other positions may be filled by members of
either the Sangha or Laity.
Article 16:
An Executive Council Standing Committee shall comprise:
·
the Head of the Congregation,
·
the Deputy Heads of the Congregation,
·
the General Secretary,
·
the Commissioner for Clergy Affairs, and
·
the Commissioner for Dharma Propagation
Article 17:
Terms of Office for:
(a)
the Board of Patrons shall be indefinite, the number of Patrons
being determined by a General Congress;
(b)
the Central Sangha Council shall be four (4) years, the number of
members being determined by the Council of Clergy; and
(c)
the Executive Council shall be four (4) years, with members of
the Council being eligible for re-appointment.
SECTION 4
RESPONSIBILITIES -
AUTHORITY
Article 18:
The Board of Patrons ensures correct spiritual, moral and religious
conduct and decorum of the Congregation.
Article 19:
The Central Sangha Council:
·
Supervises and ensures the correct implementation of
theConstitution;
·
Reviews, promotes and sanctions members of the Sangha belonging to
the Congregation;
·
Ratifies the results of General Meetings and Congresses;
·
Acts as witness to General Meetings and Congresses, major
ceremonies and Grand Convocations (Mahamandaras); and
·
Promulgates resolutions defining the courses and directions for the
activities of the Congregation.
Article 20:
The Council of Clergy has the unique task of selecting members of the
Central Sangha Council at each General Congress of the Congregation.
Article 21:
The Executive Council:
·
Motivates, encourages and supports members of the Sangha and
Buddhist Laity to practice and study their religion;
·
Implements and amends the Rules of the Congregation in accordance
with the Constitution;
·
Implements resolutions of General Congresses of the Congregation;
·
Issues Religious Messages for major ceremonies at Lunar New Year
and Vesak, Ullambana; and
·
Nominates the Head of the Congregation, the General Secretary and
the Treasurer to act on behalf of the Executive Council in maintaining
the legal status of the Congregation.
SECTION 5
DISCIPLINARY ACTION - DISMISSAL
Article 22:
Members of the Central Sangha Council and the Executive Council may be
subject to disciplinary action under the following conditions:
(a)
A member of the Central Sangha Council, the Head of the
Congregation, or a Deputy Head of the Congregation may be subject to
disciplinary action only after at least three (3) members of the Council
have sent letters to the Central Sangha Council proposing disciplinary
action. The Chief Secretary must then convene a meeting of the Central
Sangha Council within one (1) month to resolve the matter.
(b)
A member of the Executive Council may be subject to disciplinary
action only after at least five (5) members of the Executive Council
have sent letters to the Executive Council proposing disciplinary
action. The General Secretary must then convene a meeting of the
Executive Council within one (1) month to resolve the matter.
(c)
Resolutions for disciplinary action or dismissal must be decided
by all members of the relevant Council.
Article 23:
When a member of the Central Sangha Council or the Executive Council
dies or is dismissed, the relevant Council will appoint a replacement.
SECTION 6
PROPERTY AND ASSETS
Article 24:
The property and assets of the Congregation include:
·
Assets and real property donated to the Congregation; and
·
Assets and real property created by or acquired by the
Congregation.
Article 25:
Members of the Congregation are separate legal entities and are
financially and administratively independent.
SECTION 7
EXTRAORDINARY
GENERAL MEETING - GENERAL CONGRESS
Article 26:
An Extraordinary General Meeting of the Congregation must be convened by
the Head of the Congregation and the General Secretary of the Executive
Council within two (2) months of receiving written request(s) from at
least one half (1/2) of the members of the Executive Council or at least
one half (1/2) of the Buddhist institutions or organisations which are
members of the Congregation.
Article 27:
A General Congress of the Congregation is convened by the Head of the
Congregation and the General Secretary once in every four (4) years to:

Review Buddhist activities over the previous term of office;
·
Set in place Plans and Programmes of Activities for the next term;
·
Invite members to supplement the Board of Patrons, as necessary;
and
·
Invite members to sit on the Central Sangha Council; and elect the
Executive Council for the next term of office.
Article 28:
Participants at a General Congress include:
·
the Central Sangha Council,
·
the Executive Council,
·
All Sangha Members of the Congregation,
·
Delegates from constituent bodies of Buddhist Temples, Institutes,

SECTION 8
AMENDMENTS - PROMULGATION - APPLICATION
OF THE CONSTITUTION
Article 29:
Members of the Congregation may propose amendments to the Constitution
at a General Congress.
Article 30:
Motions to amend the Constitution must be sent to the Organising
Committee one (1) month prior to the General Congress and must be passed
by two thirds (2/3) of the total number of delegates attending the
General Congress before being incorporated into the Constitution.
Article 31:
The Central Sangha Council will ratify and promulgate an amended
Constitution within one (1) month of the General Congress which amended
the Constitution.
Article 32:
The Constitution of the Unified Vietnamese Buddhist Congregation in
Australia and New Zealand, consisting of eight (8) sections and
thirty-two (32) articles was amended at the Second General Congress of
the Congregation held from the 29th to 31st day of August 2003 and
promulgated to be effective from the 1st day of September 2003.
